3. Cookies

The website of Girsberger Elektronik AG - Mountain Rescue Technology uses cookies. Cookies are text files stored and saved on a computer system via an Internet browser.

Many websites and servers use cookies. Many cookies contain what is called a cookie ID, a unique identifier of the cookie. It consists of a string of characters through which websites and servers can associate the specific Internet browser in which the cookie was stored. This allows visited websites and servers to distinguish the data subject's browser from other Internet browsers that contain different cookies. A specific browser can be recognized and identified via the unique cookie ID.

By using cookies, Girsberger Elektronik AG - Mountain Rescue Technology can provide users of this website with more user-friendly services that would not be possible without the use of cookies.

Through cookies, the information and offers on our website can be optimized for the user. Cookies enable us to recognize users of our website, as mentioned earlier. The purpose of this recognition is to make it easier for users to utilize our website. For example, a user of a website that uses cookies does not need to re-enter their login credentials each time they visit the site, as this is handled by the website and the cookie stored on the user's computer system. Another example is the cookie of a shopping cart in an online shop. The online shop uses a cookie to remember the items a customer has placed in the virtual shopping cart.

The data subject can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and may thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

4. Collection of General Data and Information

The website of Girsberger Elektronik AG - Mountain Rescue Technology collects a series of general data and information with each visit by a data subject or an automated system. This general data and information are stored in the server's log files. The collected data may include:

  1. Browser types and versions used,

  2. The operating system used by the accessing system,

  3. The website from which an accessing system arrives at our website (referrer),

  4. The sub-pages accessed via an accessing system on our website,

  5. The date and time of access to the website,

  6. An Internet Protocol address (IP address),

  7. The Internet service provider of the accessing system, and

  8. Any other similar data and information used for security purposes in the event of attacks on our IT systems.

When using this general data and information, Girsberger Elektronik AG - Mountain Rescue Technology does not draw conclusions about the data subject. Instead, this information is needed to:

  1. Deliver the content of our website correctly,

  2. Optimize the content of our website and its advertising,

  3. Ensure the long-term functionality of our IT systems and website technology, and

  4. Provide law enforcement authorities with necessary information for criminal prosecution in the event of a cyberattack.

These anonymously collected data and information are statistically analyzed by Girsberger Elektronik AG - Mountain Rescue Technology to increase data protection and data security within our company, ultimately ensuring an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from any personal data provided by a data subject.

5. Subskription to our Newsletter

The website of Girsberger Elektronik AG - Mountain Rescue Technology allows users to subscribe to our company's newsletter. The input form determines what personal data are transmitted to the controller when subscribing.

Girsberger Elektronik AG - Mountain Rescue Technology informs customers and business partners regularly through a newsletter about the company's offers. A newsletter can only be received if:

  1. The data subject has a valid email address, and

  2. The data subject registers for the newsletter.

A confirmation email will be sent to the registered email address for the first time using the double opt-in procedure for legal reasons. This confirmation email is used to verify whether the owner of the email address is authorized to receive the newsletter.

During the subscription to the newsletter, we store the IP address assigned by the Internet Service Provider (ISP) and the date and time of the subscription. This data collection is necessary to understand the possible misuse of a data subject’s email address at a later date and serves the legal protection of the controller.

The personal data collected during registration for the newsletter will only be used to send our newsletter. Subscribers may also be informed via email if this is necessary for the operation of the newsletter service or registration, such as changes to the newsletter offering or technical updates. The collected personal data for the newsletter will not be shared with third parties.

The subscription to our newsletter can be terminated by the data subject at any time. The consent to the storage of personal data that the data subject has given for the newsletter subscription can be revoked at any time. A link for this purpose is included in every newsletter. Additionally, data subjects can unsubscribe directly on the controller’s website or by contacting the controller in another way.

6. Newsletter-Tracking

The newsletters of Girsberger Elektronik AG - Mountain Rescue Technology contain so-called tracking pixels. A tracking pixel is a miniature graphic embedded in emails sent in HTML format to enable log file recording and analysis. This allows statistical evaluation of the success or failure of online marketing campaigns.

Based on the embedded tracking pixel, Girsberger Elektronik AG - Mountain Rescue Technology can see if and when an email was opened by a data subject and which links in the email were clicked.

Such personal data collected via tracking pixels in the newsletters are stored and analyzed by the controller to optimize the newsletter distribution and better adapt the content of future newsletters to the interests of the data subject. These personal data are not shared with third parties.

Data subjects are entitled to revoke their separate consent, given via the double opt-in procedure, at any time. After a revocation, these personal data will be deleted by the controller. Girsberger Elektronik AG - Mountain Rescue Technology automatically interprets an unsubscription from receiving the newsletter as a revocation.

7. Contact Options via the Website

The website of Girsberger Elektronik AG - Mountain Rescue Technology includes information required by law to facilitate quick electronic contact with our company and direct communication with us. This includes a general address for electronic mail (email address).

If a data subject contacts the data controller via email or a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data voluntarily provided by a data subject to the data controller is stored for the purpose of processing or contacting the data subject. These personal data are not shared with third parties.

8. Subscription to Comments on the Blog

Comments made in the blog of Girsberger Elektronik AG - Mountain Rescue Technology can generally be subscribed to by third parties. Specifically, a commenter can opt to subscribe to follow-up comments on a specific blog post.

If a data subject chooses to subscribe to comments, the data controller sends an automatic confirmation email to verify, using the double opt-in procedure, whether the owner of the provided email address has chosen this option. The option to subscribe to comments can be terminated at any time.

9. Routine Deletion and Blocking of Personal Data

The data controller processes and stores personal data of the data subject only for the period necessary to achieve the storage purpose or as required by the European legislator or another competent legislator in laws or regulations to which the data controller is subject.

If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data is routinely blocked or deleted in accordance with legal requirements.

10. Rights of the Data Subject

  • the purposes of the processing

  • the categories of personal data being processed

  • the recipients or categories of recipients to whom the personal data has been or will be disclosed, particularly in the case of recipients in third countries or international organizations

The data subject also has the right to know whether personal data has been transferred to a third country or an international organization. Where this is the case, the data subject has the right to be informed about the appropriate safeguards relating to the transfer.

If a data subject wishes to exercise this right to access, they may contact an employee of the controller responsible for the processing at any time.

c)    Right to Rectification

Every person affected by the processing of personal data has the right, granted by the European legislator, to request the immediate rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right, taking into account the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary statement.

If a data subject wishes to exercise this right to rectification, they may contact an employee of the controller responsible for the processing at any time.

d)    Right to Erasure (Right to Be Forgotten)

Every person affected by the processing of personal data has the right, granted by the European legislator, to request from the controller the immediate deletion of personal data concerning them if one of the following reasons applies and insofar as the processing is not necessary:

If one of the above reasons applies and a data subject wishes to request the deletion of personal data stored by Girsberger Elektronik AG - Mountain Rescue Technology, they may contact an employee of the controller responsible for processing at any time. The employee of Girsberger Elektronik AG - Mountain Rescue Technology will ensure that the deletion request is promptly complied with.

If the personal data has been made public by Girsberger Elektronik AG - Mountain Rescue Technology and our company is obligated as a controller under Article 17(1) of the GDPR to delete the personal data, Girsberger Elektronik AG - Mountain Rescue Technology, taking into account the available technology and implementation costs, will take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested the deletion of all links to these personal data or copies or replications of these personal data, insofar as the processing is not required. The employee of Girsberger Elektronik AG - Mountain Rescue Technology will ensure the necessary actions are taken in each individual case.

  • The personal data was collected or otherwise processed for purposes for which it is no longer necessary.

  • The data subject withdraws their consent on which the processing is based under Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR, and there is no other legal basis for the processing.

  • The data subject objects to the processing pursuant to Article 21(1) of the GDPR, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.

  • The personal data was unlawfully processed.

  • The deletion of the personal data is required to fulfill a legal obligation under Union or Member State law to which the controller is subject.

  • The personal data was collected in relation to the offer of information society services referred to in Article 8(1) of the GDPR.

e)    Right to Restriction of Processing

Every person affected by the processing of personal data has the right, granted by the European legislator, to request the restriction of processing from the controller if one of the following conditions is met:

If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by Girsberger Elektronik AG - Mountain Rescue Technology, they may contact an employee of the controller responsible for processing at any time. The employee of Girsberger Elektronik AG - Mountain Rescue Technology will arrange for the restriction of processing.

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.

  • The processing is unlawful, and the data subject opposes the deletion of the personal data and requests instead the restriction of their use.

  • The controller no longer needs the personal data for the purposes of processing, but the data subject requires them for the establishment, exercise, or defense of legal claims.

  • The data subject has objected to processing pursuant to Article 21(1) of the GDPR, and it is not yet determined whether the legitimate grounds of the controller override those of the data subject.

f)     Right to Data Portability

Every person affected by the processing of personal data has the right, granted by the European legislator, to receive the personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit those data to another controller without hindrance from the controller to whom the personal data were provided, as long as the processing is based on consent pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR or on a contract pursuant to Article 6(1)(b) of the GDPR, and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, when exercising their right to data portability pursuant to Article 20(1) of the GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.

g)    Right to Object

Every person affected by the processing of personal data has the right, granted by the European legislator, to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them that is based on Article 6(1)(e) or (f) of the GDPR. This also applies to profiling based on these provisions.

Girsberger Elektronik AG - Mountain Rescue Technology will no longer process the personal data in the event of an objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or the processing serves to establish, exercise, or defend legal claims.

If Girsberger Elektronik AG - Mountain Rescue Technology processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning them for such marketing purposes. This also applies to profiling insofar as it is related to such direct marketing. If the data subject objects to processing for direct marketing purposes, Girsberger Elektronik AG - Mountain Rescue Technology will no longer process the personal data for these purposes.

Additionally, the data subject has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

To exercise the right to object, the data subject may directly contact any employee of Girsberger Elektronik AG - Mountain Rescue Technology or another employee. h)    Automated Individual Decision-Making, Including Profiling

Every person affected by the processing of personal data has the right, granted by the European legislator, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, provided the decision (1) is not necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is not authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the rights, freedoms, and legitimate interests of the data subject, or (3) is not based on the data subject's explicit consent.

If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is based on the data subject's explicit consent, Girsberger Elektronik AG - Mountain Rescue Technology will implement suitable measures to safeguard the data subject's rights, freedoms, and legitimate interests. These measures include at least the right to obtain human intervention on the part of the controller, to express their point of view, and to contest the decision.

If a data subject wishes to exercise rights concerning automated decision-making, they may contact an employee of the controller responsible for processing at any time.

  • Every data subject has the right to withdraw their consent to the processing of personal data at any time.

  • If a data subject wishes to exercise their right to withdraw consent, they may contact the data controller directly.

11. Privacy Policy for the Use of Facebook

The controller has integrated components of the company Facebook on this website. Facebook is a social network.

A social network is an internet-based social meeting place, an online community that usually allows users to communicate and interact in the virtual space. A social network can serve as a platform for exchanging opinions and experiences or enable the online community to provide personal or business-related information. Facebook allows users of the social network to create private profiles, upload photos, and network through friend requests.

The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject resides outside the United States or Canada, the controller responsible for the processing of personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time a page of this website, operated by the controller and containing a Facebook component (Facebook plug-in), is accessed, the internet browser on the data subject’s IT system is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be accessed at: https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook is informed about which specific subpage of our website the data subject visited.

If the data subject is logged into Facebook at the same time, Facebook detects which specific subpage of our website the data subject visits with each access to our website and for the entire duration of their stay on our website. These details are collected through the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject activates one of the Facebook buttons integrated into our website, such as the "Like" button, or submits a comment, Facebook matches this information with the data subject’s personal Facebook user account and stores the personal data.

Facebook always receives information via the Facebook component that the data subject has visited our website, provided the data subject is logged into Facebook at the time of accessing our website. This occurs regardless of whether the data subject clicks on the Facebook component or not. If such a transmission of this information to Facebook is not desired by the data subject, they can prevent this by logging out of their Facebook account before visiting our website.

The data policy published by Facebook, which is available at: https://de-de.facebook.com/about/privacy/, provides information about the collection, processing, and use of personal data by Facebook. Furthermore, it explains the privacy settings options Facebook offers to protect the privacy of the data subject. Additionally, various applications are available that allow the data subject to suppress data transmission to Facebook. Such applications can be used by the data subject to prevent data transmission to Facebook.

12. Privacy Policy for the Use of Google Analytics (with Anonymization Function)

The controller has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analytics service. Web analytics involves the collection, gathering, and analysis of data regarding the behavior of website visitors. A web analytics service collects, among other things, data on the website from which a person came (so-called referrers), which subpages were accessed, or how often and for what duration a subpage was viewed. Web analytics is primarily used to optimize a website and to perform a cost-benefit analysis of internet advertising.

The operating company for the Google Analytics component is Google Ireland Limited, Gordon House, Barrow Street, Dublin, D04 E5W5, Ireland.

The controller uses the "_gat._anonymizeIp" extension for web analytics via Google Analytics. This extension ensures that the IP address of the data subject's internet connection is anonymized by Google when accessing our website from a member state of the European Union or another state that is party to the Agreement on the European Economic Area.

Purpose of Google Analytics

The purpose of the Google Analytics component is to analyze visitor traffic on our website. Google uses the collected data and information to evaluate the use of our website, compile online reports on website activities, and provide additional services related to website and internet use.

Use of Cookies

Google Analytics places a cookie on the data subject’s IT system. Cookies have already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. Each time a page of this website, operated by the controller and containing a Google Analytics component, is accessed, the internet browser on the data subject's IT system is automatically prompted by the Google Analytics component to transmit data for online analysis to Google. As part of this technical process, Google receives information about personal data, such as the IP address of the data subject, which helps Google understand the origin of visitors and clicks and subsequently enable commission settlements.

The cookie stores personal information, such as the time of access, the location from which access originated, and the frequency of visits to our website by the data subject. Each time our website is visited, these personal data, including the IP address of the internet connection used by the data subject, are transmitted to Google in the United States of America. These personal data are stored by Google in the United States. Google may pass these personal data collected through the technical process on to third parties.

Managing and Disabling Cookies

The data subject can prevent the placement of cookies by our website, as explained above, by adjusting the settings of their internet browser and thus permanently object to the placement of cookies. Such an adjustment would also prevent Google from placing a cookie on the data subject's IT system. Additionally, cookies already placed by Google Analytics can be deleted at any time via the internet browser or other software programs.

Opt-Out from Google Analytics

Furthermore, the data subject has the option to object to and prevent the collection of data generated by Google Analytics and related to the use of this website, as well as the processing of this data by Google. For this purpose, the data subject must download and install a browser add-on via the link: https://tools.google.com/dlpage/gaoptout. This browser add-on informs Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. Google considers the installation of the browser add-on as an objection.

If the data subject's IT system is deleted, formatted, or reinstalled at a later date, they must reinstall the browser add-on to disable Google Analytics. If the browser add-on is uninstalled or deactivated by the data subject or any other person within their sphere of control, the browser add-on can be reinstalled or reactivated.

Further information and Google's applicable privacy policies can be accessed at:

Google Analytics is further explained under the following link: https://www.google.com/intl/de_de/analytics/.

13. Privacy Policy for the Use of Instagram

The controller has integrated components of the Instagram service on this website. Instagram is a service that qualifies as an audiovisual platform, enabling users to share photos and videos and distribute such data across other social networks.

The operating company of Instagram's services is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.

Each time an individual page of this website operated by the controller, which features an Instagram component (Insta-Button), is accessed, the internet browser on the data subject’s IT system is automatically prompted by the respective Instagram component to download a representation of the corresponding component from Instagram. Through this technical process, Instagram is informed about which specific subpage of our website was visited by the data subject.

If the data subject is logged into Instagram at the same time, Instagram detects which specific subpage of our website the data subject is visiting with each access to our website and throughout their entire visit. These details are collected through the Instagram component and associated with the respective Instagram account of the data subject. If the data subject activates one of the Instagram buttons integrated on our website, the data and information transmitted are linked to the data subject's personal Instagram user account and stored and processed by Instagram.

Instagram always receives information via the Instagram component that the data subject has visited our website, provided the data subject is logged into Instagram at the time of accessing our website. This happens regardless of whether the data subject clicks on the Instagram component or not. If such a transmission of information to Instagram is not desired by the data subject, they can prevent this by logging out of their Instagram account before visiting our website.

Further information and Instagram's applicable privacy policies can be accessed at:

14. Legal Basis for Processing

Article 6 I lit. a GDPR serves as the legal basis for our company for processing operations where we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, such as in processing operations necessary for the delivery of goods or the provision of any other service or consideration, the processing is based on Article 6 I lit. b GDPR. The same applies to processing operations necessary to carry out pre-contractual measures, such as inquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, such as fulfilling tax obligations, the processing is based on Article 6 I lit. c GDPR. In rare cases, the processing of personal data may become necessary to protect the vital interests of the data subject or another natural person. This could be the case, for example, if a visitor to our premises were injured, and their name, age, health insurance details, or other vital information would need to be passed on to a doctor, hospital, or other third party. In such cases, the processing would be based on Article 6 I lit. d GDPR. Finally, processing operations could be based on Article 6 I lit. f GDPR. This legal basis applies to processing operations not covered by any of the aforementioned legal bases if the processing is necessary to safeguard the legitimate interests of our company or a third party, provided these interests are not overridden by the interests, fundamental rights, and freedoms of the data subject. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator, who considered that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47 Sentence 2 GDPR).

15. Legitimate Interests in Processing Pursued by the Controller or a Third Party

If the processing of personal data is based on Article 6 I lit. f GDPR, our legitimate interest is the performance of our business activities for the well-being of all our employees and shareholders.

16. Duration for Which Personal Data Will Be Stored

The criterion for the duration of the storage of personal data is the respective statutory retention period. After the expiration of this period, the corresponding data is routinely deleted unless it is still necessary for contract fulfillment or contract initiation.

17. Legal or Contractual Requirements for the Provision of Personal Data; Necessity for Contract Conclusion; Obligation of the Data Subject to Provide Personal Data; Possible Consequences of Non-Provision

We inform you that the provision of personal data is partly required by law (e.g., tax regulations) or may also result from contractual provisions (e.g., information about the contractual partner). Sometimes, it may be necessary to provide personal data to conclude a contract, which then must be processed by us. For example, the data subject is obliged to provide us with personal data when our company concludes a contract with them. Failure to provide personal data would mean that the contract could not be concluded. Before providing personal data, the data subject must contact one of our employees. The employee will explain on a case-by-case basis whether the provision of personal data is required by law or contract, or is necessary for the contract, whether there is an obligation to provide the personal data, and what the consequences of not providing the personal data would be.

18. Existence of Automated Decision-Making

As a responsible company, we do not use automated decision-making or profiling.
